GENERAL
Nook Movement Studios is a brand by Sonja Marina Smith-Novak and is registered in Feldkirch, Austria.
Please read these Terms & Conditions carefully before using the nookmovementstudios.com website (the "Service") operated by nook movement studios ("us", "we", or "our"). These Terms & Conditions govern the way in which
we supply our online services and products to you.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these terms.
Please read these terms carefully before you submit your subscription order to us. These terms tell you who
we are, how we will provide products and services to you, how you and we may change or end the contract,
what to do if there is a problem and other important information. All rights not expressly granted in these terms
are hereby reserved.
You agree to review this agreement periodically to ensure that you are aware of any amendments to this
agreement, which may be made at any time.
By accessing or using the Service you agree to be bound by these terms. If you disagree with any part of
the terms then you may not access the Service.

GRANT OF LICENCE
After you have completed the payment for the respective nook movement studios online services and products,
we hereby grant you a licence to use the purchased services and products (“classes” or “on-demand videos”).
This licence is limited, revocable, non-exclusive, non-sublicensable and non-transferable, and is subject to the
rights and obligations granted under these Terms. This licence is personal to you and cannot be shared or
exchanged with others.

ACCESS TO MATERIALS
We grant access to all services and products on nook movement studios as per your licensing set out in these terms. However, please be aware that access may be restricted due to maintenance on the website or other unforeseen circumstances related to third party providers beyond our control. We agree to ensure that restrictions in access are as minimal as commercially viable.
The purchase of one service or product does not grant you access to any different service or program (present or future) of nook movement studios. If new products or services are added to nook movement studios, these will be
up for sale on the website separately.
Please note that access to any purchased product or service will only be granted after we have received your payment in full.
We may restrict your access to any purchased products or services if you breach these terms, including without limitation:
a) Failure to make any payment due to us; or
b) Failure to provide accurate information that is necessary for us to provide the products or services to you.
In these circumstances, we reserve the right to restrict your access to any product or service without further notice.

PURCHASES, PRICING AND PAYMENT
If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked
to supply certain information relevant to your Purchase including, without limitation, your country of residence and your email address.
When placing an order, you agree to sign up for our newsletter. You may unsubscribe at any time.
We use PayPal as third party payment provider. Payment for the products and services must be made at the point
of purchase. You agree to provide payment for the Products in EUR (€) currency and you will be liable to pay any relevant conversion charges, as well as applicable sales tax in your region.
The nook movement studios products and services are subscriptions respectively, and your ongoing payment includes the licensing of the purchased product for as long as the subscription is active for an unlimited period
of time with no ongoing or future costs.
We reserve our right to review and change the pricing of any of our products and services. This will not affect products and services that have already been purchased.
UPDATES TO PURCHASED PRODUCT
Our aim is to provide products and services of the highest quality. As such, improvements or changes to the nook movement studios products and services or any other materials may occur at any time without prior notification.
We reserve the right to continually update and change any of the available products and services on nook movement studios. Once any of these products or services has been purchased, your licence will stay vaild regardless of updates, upgrades and changes made to the content of the product or service. The amended product or service will automatically become available for you to use in your account.

CANCELLATION POLICY AND REFUNDS
Where an online product is delivered to you immediately, you will not have the right to return the purchased product. The same goes for workshop sign ups.
In other cases, you may change your mind within fourteen (14) days of purchase, so long as materials have not been downloaded, streamed or otherwise accessed or have not been provided to you.
It is your responsibility to ensure that you meet the system requirements, including compatible hardware, software, and internet service, prior to purchasing any content. We are unable to provide refunds where your access to the products is inhibited due to insufficient system requirements.
It is also your responsibility to ensure you meet the physical requirements for your chosen program. We cannot refund due to too high or too low skill or physical preparation levels required for all nook movement studios products and services respectively.
We are unable to provide a refund except at our absolute and sole discretion.

Exception is our Live Membership subscription, where you can cancel anytime within the first seven (7) days (the "Trial Period") of purchase. You do have access to all classes, on-demand videos, bonuses and the forum (and any other feature that may get added in the future) even within the Trial Period. A cancellation after the Trial Period will still allow you access to all in this paragraph mentioned products until next time the initial purchase date arrives.
Example: Subscription was started on November 5th and gets cancelled on November 20th -> Access possible until December 5th.

INTELLECTUAL PROPERTY
All rights, title and interest in intellectual property rights relating to nook movement studios products and services shall exclusively be owned by the respective teachers of nook movement studios. While you may utilise the intellectual property, you understand that there shall be no transfer of ownership of the same. Nothing that you see
or read in the products and services may be copied, reproduced, modified, distributed, transmitted, republished, displayed or performed for commercial use. All other trademarks, service marks and trade names in this material are the marks of the respective owners and any unauthorised use is prohibited.

DATA PROTECTION AND PRIVACY
We take your privacy very seriously and commit to protect all personal information transferred to us in the process
of using our service.
You agree to review and accept our Privacy Policy outlined here.

LINKS TO 3RD PARTY WEBSITES & SERVICES
Our website may contain links to third-party websites or services that are not owned or controlled by nook movement studios.
nook movement studios has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that nook movement studios shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by
or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

CHANGES TO THESE TERMS
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material
we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

RETREATS
If you would like to cancel your already booked and paid spot on the nook retreat please consider first if you can transfer your registration to someone else. You can also get in touch and ask whether there is a waiting list for this particular event. For this, simply drop us an email at we@nookmovementstudios.com.

The deposit you have made for any retreat will be non-refundable after four months prior to the first day of the scheduled event. However, if you withdraw before this you can expect a refund minus a 150€ administration charge. Further installments after you have paid the deposit are non refundable after 4 months prior to the scheduled commencement date of the retreat. There will be no refund on withdrawal from a retreat if notification is received less than four months prior to the scheduled date of the event.

In the case of an injury or sickness preventing you from taking part in the retreat, you will be able to receive a refund up until the retreat, provided you send us a doctors note attesting to your circumstances. You will receive a full refund minus a 150€ administration charge.

If the retreat is cancelled from Sonja Smith-Novak or Ivo Novak (nook), a full refund will be given of all sign ups of the cancelled event. Sonja Smith-Novak and Ivo Novak and the workshop presenters take no responsibility for non refundable travel and accommodation expenses. Please make sure to wait until final event confirmation to book any non refundable travel. We advise you to always have travel insurance when you travel to any events abroad.

Sonja Smith-Novak and Ivo Novak take no responsibility for loss of, or damage to, personal belongings, injuries or similar.
